1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the websites, APIs, dashboards, and related services (collectively, the “Services”) offered by Bitmesh AI (“we”, “us”, or “our”). By creating an account, accessing the Services, or using our API, you agree to these Terms. If you do not agree, do not use the Services.

2. The Services

We provide a platform for accessing AI models and related tools, including account management, API keys, usage metrics, and documentation. Features may change over time; we may add, modify, or discontinue functionality with reasonable notice where practicable.

3. Accounts and security

You must provide accurate registration information and keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use.

4. Acceptable use

You agree not to:

Violate applicable laws or third-party rights.
Attempt to probe, scan, or test the vulnerability of our systems without authorization.
Use the Services to generate or distribute unlawful, harmful, deceptive, or infringing content.
Resell or redistribute the Services in a way that misrepresents our relationship or bypasses technical limits.
Reverse engineer our software except where permitted by law.

5. API usage, credits, and billing

Usage may be metered (e.g. tokens, credits, or subscriptions). Fees, taxes, and payment terms are presented at checkout or in your account. Unless stated otherwise, charges are non-refundable except as required by law. We may suspend access for non-payment or suspected abuse.

6. Third-party AI providers

Our Services may route requests to third-party model providers. Their availability and output are not under our full control. Your use of such models remains subject to these Terms and any applicable provider policies.

7. Intellectual property

We retain all rights in the Services, branding, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services for your internal business purposes. You retain rights to your inputs and outputs as between you and us, subject to law and our Privacy Policy.

8. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI OUTPUTS MAY BE INACCURATE OR UNSUITABLE FOR YOUR USE CASE; YOU ARE RESPONSIBLE FOR HOW YOU USE THEM.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE THREE MONTHS BEFORE THE CLAIM OR ONE HUNDRED DOLLARS (USD), EXCEPT WHERE PROHIBITED BY LAW.

10. Termination

You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms, risk to the Services or others, or legal requirements. Provisions that by their nature should survive will survive termination.

11. Governing law

These Terms are governed by the laws applicable to your agreement with us, excluding conflict-of-law rules. Courts in the jurisdiction identified in your order or registration may have exclusive jurisdiction, unless otherwise required by law.

12. Changes

We may update these Terms from time to time. We will post the revised version on this page and update the “Last updated” date. Continued use after changes constitutes acceptance where permitted by law.
